mkv's with dolby 2.0 sound crashing xbmc

I have 2 720p mkv files with dolby digital 2.0 sound and they are both crashing xbmc. When I start either of them, they don't have any sound. So I go into audio properties and change the output from hdmi to either spdif or analog (neither of which I have connected to my amp) and I get sound and the file will play. If I change the output back to hdmi at this point, I will get sound. When I stop the file, or it finishes playing itself, it crashes xbmc. Both files behave the same way.

I extracted the sound files from the mkv's (they show as A_AC3) and run them through Womble mpeg encoder to rewrite the audio timeframes, just in case thats what the problem is, and then remux into the mkv, but the problem is still there.

Any ideas?
